On January 21, 2021, the Saeima of the Republic of Latvia adopted and on February 2, the President of the State announced amendments to the Civil Procedure Law, by which professional patent attorneys has been renewed in the right to represent their clients before the court of cassation instance (Senate of the Supreme Court) in industrial property disputes.
The new law added a fifth paragraph to Article 82.1 of the Civil Procedure Law, which provides that “cases of natural and legal persons regarding infringements and protection of industrial property rights and cases referred to in Paragraph one, Clause 3 of this Article may also be brought in cassation court through a professional patent attorney”, also retaining the right to represent clients in matters relating to the protection of trade secrets against their unlawful acquisition, use and disclosure. The law will enter into force on March 1 this year.
